ACCC Undertaking

In November 2016, Qube and AAT gave a court-enforceable undertaking to the Australian Competition and Consumer Commission (ACCC) to enable Qube to acquire the other half of AAT that it did not already own (Undertaking). Qube has also developed a Management Manual to summarise the obligations of the Qube Group and its related entities associated with the Undertaking.  A copy of the Undertaking (as subsequently varied) and a summary of it, together with the Management Manual are available below.

Under the Undertaking, Qube (and AAT) must permit a person to raise a non-price dispute under the non-price dispute resolution process provided for in the Undertaking.  Non-price disputes may relate to such matters as the granting of access, any refusal to grant access or the terms of access.  They may also include disputes in relation to whether AAT has complied with its open access conditions or its obligations in relation to confidentiality and ring-fencing.  Notification to Qube of a non-price dispute can be made by emailing Qube’s company secretary at:  companysecretary@qube.com.au.
